L'ex première de Côte d'Ivoire est désormais libre après la décision du président ivoirien Alassane Ouattara d'amnistier 800 prisonniers.

Cette liberté ne signifie pas pour autant la fin des poursuites engagées contre Simone Gbagbo.
Celles de la Cour pénale internationale (CPI), indépendantes de l'action des juridictions ivoiriennes sont toujours d'actualité.
Dans un communiqué diffusé dans la foulée de la libération de Simone Gbagbo, la CPI a clairement fait savoir que le mandat d'arrêt contre Mme Gbagbo "est toujours en vigueur". La CPI a donc rappelé "à la Côte d'Ivoire son obligation de remettre sans délai Mme Gbagbo à la Cour".

"Mme Gbagbo doit être arrêtée sur la base de ce mandat et transférée à la CPI pour y être poursuivie. Toute amnistie qui pourrait avoir été accordée n'a aucun impact sur les procédures devant la CPI", précise la juridiction.

La CPI a délivré contre Simone Gbagbo un mandat d'arrêt en février 2012 mais le président Ouattara a finalement affirmé en 2016 qu'il "n'enverrait plus d'Ivoiriens" à la CPI, estimant que la Côte d'Ivoire avait désormais une "justice opérationnelle".

La défense de Simone Gbagbo se prépare à engager "en septembre (…) une procédure pour annuler les poursuites contre elle", précise Me Dadjé Rodrigue l'avocat de l'ex-première dame de Côte d'Ivoire.
